1. Agreement to Terms

By accessing or using Poptropica Club ("the Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Poptropica Club regarding your use of the Service.

2. Fan Project Disclaimer

Poptropica Club is an independent fan project.

We are not affiliated with, endorsed by, sponsored by, or connected to Sandbox Networks, StoryArc Media, Pearson Education, the Family Education Network, or any other entity that has owned or operated the official Poptropica game.

"Poptropica" and related trademarks, characters, and content are the property of their respective owners. This Service is a non-commercial fan preservation project created out of appreciation for the original game.

We respect the intellectual property rights of the original creators. If any rights holder has concerns about this project, please contact us.

3. Eligibility

Age Requirement

You must be at least 13 years old to create an account or use the Service.

By creating an account, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you have obtained permission from a parent or legal guardian to use the Service

We do not knowingly collect information from or direct the Service to children under 13. If we learn that a user is under 13, we will terminate their account and delete associated data.

Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

You may not share, sell, transfer, or allow others to use your account.

4. Poptropica Passport Accounts

Account Creation

When you create a Poptropica Passport account, you agree to:

  • Provide accurate and complete information
  • Keep your account information up to date
  • Choose a username that does not impersonate others, contain offensive content, or violate any third party's rights
  • Use a strong, unique password

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Suspected fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Requests from law enforcement or government agencies
  • Technical or security issues

You may delete your account at any time by contacting us.

5. Acceptable Use Policy

You Agree NOT To:

Harmful Conduct

  • Harass, bully, threaten, or intimidate other users
  • Engage in hate speech, discrimination, or promote violence
  • Impersonate any person or entity
  • Stalk or invade the privacy of others

Security Violations

  • Attempt to gain unauthorized access to accounts, systems, or data
  • Use bots, scripts, or automated tools without permission
  • Exploit bugs, glitches, or vulnerabilities (report them to us instead)
  • Distribute malware, viruses, or malicious code
  • Attempt to reverse engineer, decompile, or extract source code from the Service

Abuse of Service

  • Use the Service for any illegal purpose
  • Interfere with or disrupt the Service or servers
  • Circumvent any access restrictions or security measures
  • Create multiple accounts to evade bans or restrictions
  • Spam, advertise, or promote external services without permission

Content Violations

  • Share content that is illegal, obscene, or pornographic
  • Share content depicting minors in inappropriate situations
  • Infringe on intellectual property rights of others
  • Share personal information of others without consent

6. User-Generated Content

Your Content

You retain ownership of any content you create or upload to the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating the Service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate these Terms or any applicable law
  • Your User Content does not infringe on the rights of any third party

Our Rights

We may, but are not obligated to, monitor, edit, or remove User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

7. Intellectual Property

Our Content

The Service includes content owned or licensed by us, including but not limited to text, graphics, logos, and software (excluding Poptropica intellectual property owned by third parties). This content is protected by copyright, trademark, and other laws.

Third-Party Content

Poptropica game content, characters, artwork, and related intellectual property are owned by their respective rights holders. Our use of this content is for fan preservation purposes, and we make no claim of ownership over these materials.

Your License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

8. Virtual Items and Game Progress

No Monetary Value

Any virtual items, currency, achievements, or game progress within the Service have no real-world monetary value. You acknowledge that:

  • Virtual items cannot be exchanged for real currency
  • We may modify, suspend, or discontinue virtual items at any time
  • Virtual items may be lost due to technical issues, and we are not obligated to restore them

No Refunds

As a free service, there are no purchases and therefore no refunds. If we introduce paid features in the future, a separate refund policy will be provided.

9. Third-Party Services and Links

The Service may contain links to third-party websites, advertisements, or services that are not owned or controlled by us. We are not responsible for:

  • The content, privacy policies, or practices of third-party services
  • Any damage or loss caused by your use of third-party services

No Guarantees

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service or servers are free of viruses or harmful components
  • Your game progress or data will be preserved indefinitely

Fan Project Risks

As an unofficial fan project, you acknowledge that:

  • The Service may be discontinued at any time without notice
  • The Service may be subject to takedown requests from rights holders
  • Features may change or be removed without warning

11. Limitation of Liability

Maximum Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POPTROPICA CLUB AND ITS OPERATORS, VOLUNTEERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY: INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES; DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT; DAMAGES RESULTING FROM INTERRUPTION OR CESSATION OF THE SERVICE.

Basis of the Bargain

YOU ACKNOWLEDGE THAT THIS LIMITATION OF LIABILITY IS AN ESSENTIAL ELEMENT OF THESE TERMS AND THAT THE SERVICE WOULD NOT BE PROVIDED WITHOUT THESE LIMITATIONS.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Poptropica Club and its operators, volunteers, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your User Content

13. Dispute Resolution

Informal Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us. We will attempt to resolve the dispute within 30 days.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date at the top of this document
  • We will provide notice of material changes through the Service or via email
  • Continued use of the Service after changes constitutes acceptance of the new Terms

If you do not agree to the modified Terms, you must stop using the Service and delete your account.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Poptropica Club regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder. We may assign our rights and obligations without restriction.

No Agency

Nothing in these Terms creates any agency, partnership, or joint venture between you and Poptropica Club.

By using Poptropica Club, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
